Terms of Service

1. Who we are

These Terms govern your use of UV Gen, an AI tool for creating images, textures, and 3D materials, available at https://uvgen.com. UV Gen is operated by Maxime Raafat, a sole proprietor in Switzerland ("we", "us"). Our contact details are in the Legal notice. By creating an account or using UV Gen, you agree to these Terms and to our Privacy Policy.

2. Alpha service

UV Gen is in alpha. Features, models, credit costs, and output quality may change, and the service may be interrupted or unavailable at times. We show the credit cost of each action before you generate. We may add, change, or remove models and features as the service evolves. This does not limit any mandatory cancellation or refund rights you may have if a change materially reduces a paid plan.

3. Your account

  • You must be at least 18 years old to use UV Gen.
  • Provide accurate information and keep your login details secure. You are responsible for activity on your account.
  • One person per account. Do not share accounts or create multiple accounts to obtain additional free credits.
  • If you use UV Gen for a business, you confirm you are allowed to accept these Terms on its behalf.

4. Plans, credits, and payments

  • Generating content uses credits. The cost is shown before each generation, and failed generations are refunded automatically.
  • The Free plan includes a one-time credit grant for personal, non-commercial use. Free credits do not expire.
  • Indie and Studio plans are subscriptions that renew automatically each month or year until cancelled. Each billing period grants plan credits, which are used first and expire at the end of that period.
  • Subscribers can buy top-up credits. Top-up credits do not expire and are used after plan credits.
  • Credits have no cash value, cannot be transferred or resold, and are not refunded when unused, except as described in section 5.
  • Upgrades take effect immediately; you pay the prorated price difference and receive the additional credits right away. Downgrades and switches from yearly to monthly take effect at the end of the current period.
  • Prices are shown in US dollars and include applicable sales tax or VAT. Your bank may convert currency or charge fees.
  • We will notify you at least 30 days before a price increase applies to your subscription, so you can cancel before it takes effect.

Payments are processed by Stripe through Link, which acts as the seller of record and sends your receipts and invoices. Link's own terms apply to the payment itself.

5. Cancellation and refunds

  • You can cancel at any time in Billing → Manage or cancel subscription, or through your Link account. Your plan stays active, with its credits, until the end of the paid period and then does not renew.
  • Except where required by law, we do not refund partial billing periods.
  • EU and UK consumers may withdraw from a purchase within 14 days. Because you ask us to provide the service immediately, if you withdraw after using credits we refund the price minus the value of the credits used.
  • If a payment is fully refunded, unused credits from that payment are removed. A partial refund leaves your credits unchanged.
  • For any billing problem, please contact support@uvgen.com before opening a dispute with your bank. We will help.

6. Your content

"Your content" means the prompts, images, and other material you upload or enter, and the images, textures, and material maps generated for you ("outputs").

  • You keep any rights you have in your uploads. You confirm that you own them or have permission to use them in this way.
  • You give us a limited licence to store, process, and send your content to our service providers solely to operate UV Gen for you, keep it secure, and provide support. This licence ends when you delete the content, except for routine backups that expire.
  • We do not use your content to train AI models unless you opt in, and we do not publish or showcase it without your permission.
  • We may use anonymised, aggregated usage data, such as which features and settings are popular, to improve UV Gen.
  • You can delete uploads, generated images, and textures in the app at any time.

7. Outputs and commercial use

  • To the extent we hold any rights in your outputs, we assign them to you.
  • Outputs created while you have an active Indie or Studio plan may be used commercially, including after you cancel. Outputs created on the Free plan are for personal, non-commercial use only.
  • AI outputs may not be unique: other users may receive similar results, and some outputs may not be protectable by copyright.
  • Neither we nor our AI model providers guarantee that outputs are free of third-party rights such as copyright, trademarks, or likeness rights. You are responsible for checking that your use of an output is lawful, especially before commercial use.
  • If you publish realistic outputs that could be mistaken for real people, places, or events, you are responsible for any legally required disclosure that they are AI-generated.

8. Acceptable use

You must not use UV Gen to create, upload, or share content that:

  • violates applicable law, including the laws of Switzerland or the place where you use the service;
  • is sexually explicit, or sexualises minors in any way;
  • creates intimate or degrading imagery of a real person without their consent;
  • infringes someone else's intellectual property, privacy, or publicity rights;
  • promotes or facilitates terrorism or real-world violence, harasses or threatens anyone, or incites hatred;
  • is intended to deceive, defraud, or impersonate others.

You also must not:

  • bypass credit limits, rate limits, content filters, or other safeguards;
  • scrape, overload, or attack the service, or reverse engineer it except where the law allows;
  • resell or provide access to UV Gen as a service to third parties without our written permission;
  • use outputs to build or train a competing AI image or material generation service.

Fictional violent, gory, or dark creative content, such as battle damage or horror environments, is allowed. We may use proportionate safeguards to enforce these rules.

9. Reporting content

To report content that is illegal or infringes your rights, email support@uvgen.com with the subject "Content report". Include where the content appears, why it is illegal or infringing, your name and contact details (unless you report child sexual abuse material), and a statement that your report is accurate and made in good faith. We review reports promptly, may remove or disable content, and tell the affected user what we removed and why. Users can reply to contest a decision. We suspend accounts that repeatedly break these Terms.

10. Suspension and termination

You may stop using UV Gen at any time and ask us to delete your account at support@uvgen.com. We may suspend or close accounts that seriously or repeatedly break these Terms, misuse the service, or create legal risk. Where reasonable, we will warn you first. If we close your account without you being at fault, we will refund any unused prepaid amount.

11. Our responsibility

We work carefully to keep UV Gen running and your content safe, but the service is provided as it is, during an alpha, without guarantees of availability, accuracy, or fitness for a particular purpose. Keep copies of outputs you need.

To the extent permitted by law, we are not liable for slight negligence, indirect or consequential loss, lost profits, or lost data, and our total liability is limited to the amount you paid us in the 12 months before the claim. These limits do not apply to liability for intent or gross negligence, for personal injury, or where mandatory consumer law does not allow them.

If you use UV Gen for business purposes, you will compensate us for third-party claims caused by your content or by your breach of these Terms.

12. Changes to these Terms

We may update these Terms as UV Gen evolves or the law changes. The current version is always on this page, and minor changes, such as clarifications or new features, apply once published. If a change materially affects your rights or what you pay for, we will notify you in the app or by email at least 30 days before it takes effect. If you do not agree, you may cancel before then; continuing to use UV Gen afterwards means you accept it.

13. Governing law

These Terms are governed by Swiss law, excluding the UN Convention on Contracts for the International Sale of Goods. The courts of Zurich, Switzerland, have jurisdiction. If you are a consumer, you keep the protection of the mandatory laws of your country of residence and may also bring claims in its courts.

14. Other terms

  • If any part of these Terms is invalid, the rest remains in effect.
  • We may transfer these Terms to a company we set up to run UV Gen, or to a successor of the business. We will tell you if this happens, and your rights under these Terms stay the same.
  • You may not use UV Gen if you are subject to Swiss, EU, UN, or US sanctions, or in violation of export-control laws.
